Frequently Asked Questions

Frequently Asked Questions

1. How can I check whether a plot of land is part of a nature conservation area?
Whether a plot is part of the Protected Natural Areas (PNA), the Emerald Network, or their buffer zones is verified using information from the State Land Cadastre (SLC), urban planning documentation, and the Cadastre of Protected Natural Areas, which is reflected in the SLC extract as legal restrictions. If no data is available in the SLR, a request is submitted to the regional department of ecology and the State Geocadastre.
2. Regulations Governing the Use of Coastal Protection Zones (CPZs)
In accordance with Article 89 of the Water Code and Article 61 of the Land Code of Ukraine, the following activities are prohibited within the boundaries of the Protected Area: plowing of land (except for grass planting and afforestation), gardening, vegetable gardening, the use and storage of pesticides and fertilizers, the establishment of summer camps for livestock, the washing and maintenance of vehicles, the burning of dry vegetation, and the establishment of landfills, manure pits, waste storage sites, cemeteries, livestock burial grounds, and filtration fields. It is also prohibited to construct any structures, recreational facilities, summer cottages, garages, and parking lots, except for hydraulic, navigational, hydrometric, linear, and fortification structures, fences, utility lines, and temporary open-air sports fields. Within the Protected Zone, the following activities are permitted: haymaking, grazing livestock, shoreline stabilization, clearing riverbeds, establishing open recreational areas without permanent structures, as well as the reconstruction, restoration, and major repairs of existing facilities. Existing structures may be operated provided that the protected area’s regulations are observed, while unsuitable or non-compliant facilities must be removed.
3. What steps should a community take upon discovering an illegal dump?
In accordance with the laws “On Waste Management” and “On Local Self-Government in Ukraine,” the local government establishes a commission to inspect the landfill, determine the volume of waste, and draw up a report. The State Land Cadastre is used to identify the owner or user of the plot: a private owner or lessee is issued a notice to remedy the violation, while on municipal land, the cleanup is organized by the local council. To hold the responsible parties accountable under Article 82 of the Code of Administrative Offenses, the case materials are forwarded to the State Environmental Inspection and the police.
